Avrupa \u0130nsan Haklar\u0131 Mahkemesi (A\u0130HM) B\u00fcy\u00fck Dairesi, Osman Kavala\u2019n\u0131n ikinci ba\u015fvurusuna ili\u015fkin karar\u0131nda T\u00fcrkiye\u2019nin Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesi\u2019ni ihlal etti\u011fine 15\u2019e kar\u015f\u0131 2 oyla h\u00fckmetti.<\/p>\n\n\n\n

Kararda, T\u00fcrkiye\u2019nin ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fc d\u00fczenleyen 10. madde, toplant\u0131 ve \u00f6rg\u00fctlenme \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fc d\u00fczenleyen 11. madde, adil yarg\u0131lanma hakk\u0131na ili\u015fkin 6. madde, \u00f6zg\u00fcrl\u00fck ve g\u00fcvenlik hakk\u0131n\u0131 d\u00fczenleyen 5. madde ile haklara getirilen s\u0131n\u0131rlamalar\u0131n amac\u0131yla ilgili 18. maddeyi ihlal etti\u011fi belirtildi.<\/p>\n\n\n\n

Mahkeme, i\u00e7 hukuk mahkemelerinin Kavala\u2019n\u0131n \u00fc\u00e7\u00fcnc\u00fc ki\u015filerin ger\u00e7ekle\u015ftirdi\u011fi \u015fiddet eylemlerine do\u011frudan kat\u0131ld\u0131\u011f\u0131n\u0131 ortaya koymadan, sivil toplum faaliyetleri ile Gezi Park\u0131 eylemlerine ili\u015fkin \u00e7al\u0131\u015fmalar\u0131n\u0131 a\u011f\u0131r su\u00e7lar\u0131n unsurlar\u0131yla ili\u015fkilendirdi\u011fini kaydetti. Bu yakla\u015f\u0131m\u0131n Kavala\u2019ya \u201ca\u00e7\u0131k\u00e7a orant\u0131s\u0131z ve keyfi\u201d bir cezai sorumluluk y\u00fckledi\u011fi ifade edildi.<\/p>\n\n\n\n
Kararda ayr\u0131ca, yarg\u0131laman\u0131n adilli\u011fi ile mahkemelerin ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131 ve tarafs\u0131zl\u0131\u011f\u0131 konusunda ciddi eksiklikler bulundu\u011fu, T\u00fcrkiye\u2019de yarg\u0131 ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131n\u0131 zay\u0131flatan daha geni\u015f yap\u0131sal sorunlar\u0131n da davay\u0131 etkiledi\u011fi belirtildi.<\/p>\n\n\n\n
A\u0130HM, Kavala\u2019ya manevi zarar kar\u015f\u0131l\u0131\u011f\u0131nda 70 bin avro, yarg\u0131lama giderleri ve masraflar i\u00e7in 43 bin 342,57 avro \u00f6denmesine karar verdi. T\u00fcrkiye\u2019nin \u00f6deyece\u011fi toplam tutar 113 bin 342,57 avro oldu.<\/p>\n\n\n\n
