Bu karar, y\u0131llard\u0131r ad\u0131m ad\u0131m in\u015fa edilen siyasal ve toplumsal d\u00fczenin bir sonucudur. Ortada m\u00fcnferit bir olay de\u011fil, gericili\u011fin, cezas\u0131zl\u0131\u011f\u0131n ve siyasal koruman\u0131n \u00fcretti\u011fi yap\u0131sal bir ger\u00e7eklik bulunmaktad\u0131r.<\/p>\n\n\n\n<p>Bug\u00fcn ortaya \u00e7\u0131kan tabloyu yaln\u0131zca bir ki\u015finin i\u015fledi\u011fi su\u00e7la a\u00e7\u0131klamaya \u00e7al\u0131\u015fmak ger\u00e7e\u011fi perdelemek olur. \u00c7\u00fcnk\u00fc H.K.G.&#8217;nin ya\u015fad\u0131klar\u0131, y\u0131llard\u0131r tarikatlar\u0131n, cemaatlerin ve onlar\u0131n siyasal hamilerinin yaratt\u0131\u011f\u0131 karanl\u0131k d\u00fczenin \u00fcr\u00fcn\u00fcd\u00fcr. \u00c7ocuklar\u0131n tarikat yurtlar\u0131nda u\u011frad\u0131\u011f\u0131 istismarlar, cemaat evlerinde ya\u015fanan bask\u0131lar, kad\u0131nlar\u0131n iradesini yok sayan anlay\u0131\u015flar ve \u00e7ocuk ya\u015fta evlilikleri me\u015frula\u015ft\u0131rmaya \u00e7al\u0131\u015fan zihniyet birbirinden ba\u011f\u0131ms\u0131z de\u011fildir. Hepsi ayn\u0131 ideolojik kaynaktan beslenmektedir.<\/p>\n\n\n\n<p>Bu nedenle bug\u00fcn kar\u015f\u0131m\u0131zda duran ger\u00e7ek, yaln\u0131zca bir istismar davas\u0131n\u0131n sonucu de\u011fil, y\u0131llard\u0131r topluma dayat\u0131lan gerici anlay\u0131\u015f\u0131n ger\u00e7ek y\u00fcz\u00fcd\u00fcr.<\/p>\n\n\n\n<p>Hat\u0131rlayal\u0131m. Ensar Vakf\u0131&#8217;nda onlarca \u00e7ocu\u011fun cinsel istismara u\u011frad\u0131\u011f\u0131 ortaya \u00e7\u0131kt\u0131\u011f\u0131nda d\u00f6nemin Aile ve Sosyal Politikalar Bakan\u0131 taraf\u0131ndan s\u00f6ylenen &#8220;Bir kereden bir \u015fey olmaz&#8221; s\u00f6zleri toplumsal haf\u0131zaya kaz\u0131nm\u0131\u015ft\u0131. O g\u00fcn milyonlarca insan bu s\u00f6zlere \u00f6fkeyle tepki g\u00f6sterdi. \u00c7\u00fcnk\u00fc mesele yaln\u0131zca talihsiz bir ifade de\u011fildi. O s\u00f6zler, \u00e7ocuklar\u0131n ya\u015fad\u0131klar\u0131 ac\u0131y\u0131 k\u00fc\u00e7\u00fcmseyen, failleri koruyan ve istismar\u0131 s\u0131radanla\u015ft\u0131ran zihniyetin d\u0131\u015favurumuydu.<\/p>\n\n\n\n<p>Bug\u00fcn H.K.G. davas\u0131nda ya\u015fananlar, i\u015fte o anlay\u0131\u015f\u0131n nereye vard\u0131\u011f\u0131n\u0131 g\u00f6stermektedir.<\/p>\n\n\n\n<p>&#8220;Bir kereden bir \u015fey olmaz&#8221; diyen mant\u0131k ile alt\u0131 ya\u015f\u0131ndaki bir \u00e7ocu\u011fun y\u0131llarca ya\u015fad\u0131\u011f\u0131 cehennemi g\u00f6rmezden gelen mant\u0131k ayn\u0131d\u0131r.<\/p>\n\n\n\n<p>\u00c7ocuklar\u0131n de\u011fil kurumlar\u0131n itibar\u0131n\u0131 koruyan mant\u0131k ayn\u0131d\u0131r.<\/p>\n\n\n\n<p>Ma\u011fdurlar\u0131n de\u011fil faillerin haklar\u0131n\u0131 \u00f6nceleyen mant\u0131k ayn\u0131d\u0131r.<\/p>\n\n\n\n<p>Tarikatlar\u0131 ve cemaatleri sorgulamak yerine onlar\u0131 devlet olanaklar\u0131yla b\u00fcy\u00fcten mant\u0131k ayn\u0131d\u0131r.<\/p>\n\n\n\n<p>\u00c7\u00fcnk\u00fc bu anlay\u0131\u015f i\u00e7in esas olan \u00e7ocu\u011fun g\u00fcvenli\u011fi de\u011fil, kurulan siyasal ve ideolojik d\u00fczenin devam\u0131d\u0131r.<\/p>\n\n\n\n<p>Bug\u00fcn T\u00fcrkiye&#8217;de \u00e7ocuk istismarlar\u0131n\u0131n \u00f6nemli bir b\u00f6l\u00fcm\u00fcn\u00fcn tarikatlar, cemaatler ve denetimsiz dini yap\u0131lar i\u00e7erisinde ortaya \u00e7\u0131kmas\u0131 tesad\u00fcf de\u011fildir. Bu yap\u0131lar y\u0131llard\u0131r devlet taraf\u0131ndan korunmu\u015f, te\u015fvik edilmi\u015f ve kamusal alan\u0131n i\u00e7erisine yerle\u015ftirilmi\u015ftir. E\u011fitimden sosyal hizmetlere, \u00f6\u011frenci yurtlar\u0131ndan \u00e7ocuk bak\u0131m\u0131na kadar bir\u00e7ok alan tarikat ve cemaat a\u011flar\u0131na a\u00e7\u0131lm\u0131\u015ft\u0131r. Sonu\u00e7 ise ortadad\u0131r. \u0130stismar, bask\u0131, \u015fiddet ve \u00e7ocuklar\u0131n karart\u0131lan hayatlar\u0131&#8230;<\/p>\n\n\n\n<p>Ancak daha da vahim olan, b\u00fct\u00fcn bunlara ra\u011fmen ger\u00e7ek bir hesapla\u015fman\u0131n ya\u015fanmamas\u0131d\u0131r.<\/p>\n\n\n\n<p>\u00c7ocuklar istismar edildi\u011finde &#8220;istisna&#8221; deniliyor.<\/p>\n\n\n\n<p>Tarikat yurtlar\u0131nda skandallar ortaya \u00e7\u0131kt\u0131\u011f\u0131nda &#8220;kurumu y\u0131pratmayal\u0131m&#8221; deniliyor.<\/p>\n\n\n\n<p>Kad\u0131nlar \u015fiddete u\u011frad\u0131\u011f\u0131nda &#8220;aileyi koruyal\u0131m&#8221; deniliyor.<\/p>\n\n\n\n<p>Ama ne hikmetse korunmas\u0131 gerekenler her zaman ma\u011fdurlar de\u011fil, onlar\u0131 ma\u011fdur eden yap\u0131lar oluyor.<\/p>\n\n\n\n<p>Yusuf Ziya G\u00fcm\u00fc\u015fel&#8217;in tahliyesi de tam olarak bu tablonun par\u00e7as\u0131d\u0131r. \u00c7\u00fcnk\u00fc ayn\u0131 \u00fclkede y\u00fczlerce a\u011f\u0131r hasta mahpus cezaevlerinde \u00f6l\u00fcmle pen\u00e7ele\u015firken, y\u0131llard\u0131r infaz ertelemesi talepleri reddedilirken, tedavi hakk\u0131 sistematik bi\u00e7imde gasp edilirken, \u00e7ocuk istismar\u0131yla \u00f6zde\u015fle\u015fmi\u015f bir davan\u0131n san\u0131\u011f\u0131n\u0131n sa\u011fl\u0131k gerek\u00e7esiyle tahliye edilmesi s\u0131radan bir hukuk uygulamas\u0131 olarak g\u00f6r\u00fclemez. Bu durum, hukukun kime kar\u015f\u0131 sert, kime kar\u015f\u0131 esnek davrand\u0131\u011f\u0131n\u0131 g\u00f6steren politik bir tercihtir.<\/p>\n\n\n\n<p>Burada kar\u015f\u0131m\u0131za \u00e7\u0131kan \u015fey yaln\u0131zca yarg\u0131n\u0131n sorunu de\u011fildir. Sorun daha derindedir. Bu y\u00fczden cezaevlerinde \u00f6l\u00fcmc\u00fcl hastal\u0131klarla bo\u011fu\u015fan devrimci tutsaklar tahliye edilmezken, kamu vicdan\u0131n\u0131 yaralayan davalarda farkl\u0131 uygulamalar devreye girebilmektedir.<\/p>\n\n\n\n<p>Bu bir \u00e7ifte standart de\u011fil, sistemin karakteridir.<\/p>\n\n\n\n<p>\u00c7\u00fcnk\u00fc bu d\u00fczenin adaleti s\u0131n\u0131fsald\u0131r.<\/p>\n\n\n\n<p>Bu d\u00fczenin hukuku siyasal tercihlerden ba\u011f\u0131ms\u0131z de\u011fildir.<\/p>\n\n\n\n<p>Bu d\u00fczenin vicdan\u0131 ise \u00e7ocuklardan, kad\u0131nlardan ve emek\u00e7ilerden yana de\u011fil; iktidar\u0131n ideolojik ve toplumsal dayanaklar\u0131ndan yanad\u0131r.<\/p>\n\n\n\n<p>Bu nedenle H.K.G. davas\u0131 yaln\u0131zca bir mahkeme dosyas\u0131 de\u011fildir. Bu dava, \u00e7ocuklar\u0131n nas\u0131l korunamad\u0131\u011f\u0131n\u0131n, gerici yap\u0131lar\u0131n nas\u0131l b\u00fcy\u00fct\u00fcld\u00fc\u011f\u00fcn\u00fcn, devletin denetim mekanizmalar\u0131n\u0131n nas\u0131l bilin\u00e7li bi\u00e7imde etkisizle\u015ftirildi\u011finin ve hukukun nas\u0131l siyasalla\u015ft\u0131\u011f\u0131n\u0131n sembol\u00fc haline gelmi\u015ftir.<\/p>\n\n\n\n<p>Bug\u00fcn \u00f6fke duyulmas\u0131 gereken \u015fey yaln\u0131zca bir tahliye karar\u0131 de\u011fildir. \u00d6fke duyulmas\u0131 gereken \u015fey, \u00e7ocuklar\u0131n hayatlar\u0131n\u0131 karartan yap\u0131lar\u0131 y\u0131llard\u0131r besleyen, koruyan ve me\u015frula\u015ft\u0131ran d\u00fczendir. \u00c7\u00fcnk\u00fc \u00e7ocuk istismar\u0131 bireysel sapk\u0131nl\u0131klar\u0131n de\u011fil, ayn\u0131 zamanda gerici ideolojilerin ve onlar\u0131 koruyan siyasal ili\u015fkilerin \u00fcr\u00fcn\u00fcd\u00fcr.<\/p>\n\n\n\n<p>Alt\u0131 ya\u015f\u0131ndaki bir \u00e7ocu\u011fun hayat\u0131ndan \u00e7al\u0131nan y\u0131llar geri getirilemez. Ancak bu karanl\u0131\u011f\u0131n kayna\u011f\u0131 do\u011fru te\u015fhis edilmeden de ger\u00e7ek bir adalet m\u00fccadelesi verilemez. Bug\u00fcn yap\u0131lmas\u0131 gereken, yaln\u0131zca bir faili mahk\u00fbm etmek de\u011fil; tarikatlar\u0131n \u00e7ocuklar \u00fczerindeki tahakk\u00fcm\u00fcne, gericili\u011fin toplumsal ya\u015fam\u0131 ku\u015fatmas\u0131na ve bu yap\u0131lar\u0131 koruyan siyasal d\u00fczene kar\u015f\u0131 m\u00fccadeleyi b\u00fcy\u00fctmektir.<\/p>\n\n\n\n<p>\u00c7\u00fcnk\u00fc \u00e7ocuklar\u0131n de\u011fil istismarc\u0131lar\u0131n korundu\u011fu, hasta tutsaklar\u0131n \u00f6l\u00fcme terk edildi\u011fi, tarikatlar\u0131n ise devlet korumas\u0131 alt\u0131nda b\u00fcy\u00fcd\u00fc\u011f\u00fc bir yerde sorun tek tek ki\u015filer de\u011fil, bizzat d\u00fczenin kendisidir.
