Yarg\u0131 Paketi&#8221; olarak adland\u0131r\u0131lan yeni d\u00fczenleme, adalet sisteminin sorunlar\u0131na \u00e7\u00f6z\u00fcm \u00fcretmekten \u00e7ok, devlet ayg\u0131t\u0131n\u0131n ihtiya\u00e7lar\u0131na g\u00f6re yeniden \u015fekillendirilmesinin bir ad\u0131m\u0131 olarak kar\u015f\u0131m\u0131za \u00e7\u0131k\u0131yor. Paket, iktidar\u0131n y\u0131llard\u0131r s\u00fcrd\u00fcrd\u00fc\u011f\u00fc yarg\u0131y\u0131 siyasal iktidar\u0131n ihtiya\u00e7lar\u0131na g\u00f6re dizayn etme politikas\u0131n\u0131n yeni halkas\u0131n\u0131 olu\u015fturuyor.<\/p>\n\n\n\n<p>Yarg\u0131 ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131n\u0131n fiilen ortadan kalkt\u0131\u011f\u0131, siyasi davalar\u0131n hukuki de\u011fil siyasal saiklerle y\u00fcr\u00fct\u00fcld\u00fc\u011f\u00fc, d\u00fc\u015f\u00fcnce ve \u00f6rg\u00fctlenme \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn bask\u0131 alt\u0131na al\u0131nd\u0131\u011f\u0131 bir \u00fclkede, iktidar bir kez daha halk\u0131n adalet talebini de\u011fil devletin y\u00f6netme kapasitesini g\u00fc\u00e7lendirmeyi tercih ediyor.<\/p>\n\n\n\n<p>Cezaevleri Dolu, Hasta Tutsaklar \u00d6l\u00fcmle Y\u00fcz Y\u00fcze; \u0130ktidar\u0131n G\u00fcndeminde De\u011fil<\/p>\n\n\n\n<p>T\u00fcrkiye cezaevleri tarihinin en y\u00fcksek doluluk oranlar\u0131ndan birini ya\u015f\u0131yor. Binlerce hasta mahpus tedavi hakk\u0131ndan yoksun b\u0131rak\u0131l\u0131rken, siyasi tutsaklar \u00fczerindeki tecrit ve izolasyon politikalar\u0131 derinle\u015firken, kamuoyunda uzun s\u00fcredir tart\u0131\u015f\u0131lan infaz d\u00fczenlemesi bu pakette yer alm\u0131yor.<\/p>\n\n\n\n<p>Bu tercih tesad\u00fcf de\u011fildir. \u00c7\u00fcnk\u00fc iktidar\u0131n \u00f6nceli\u011fi cezaevlerindeki hak ihlallerini gidermek de\u011fil, bask\u0131 ve denetim mekanizmalar\u0131n\u0131 korumakt\u0131r. Siyasal muhalefeti cezaland\u0131rman\u0131n ara\u00e7lar\u0131ndan biri haline getirilen infaz sistemi oldu\u011fu gibi muhafaza edilmektedir.<\/p>\n\n\n\n<p>Devlet \u0130\u00e7in Kolayl\u0131k, Halk \u0130\u00e7in Yeni Engeller<\/p>\n\n\n\n<p>Yeni d\u00fczenlemeyle ki\u015finin devlete kar\u015f\u0131 kazand\u0131\u011f\u0131 davalarda alaca\u011f\u0131n\u0131 tahsil etmesinin \u00f6n\u00fcne yeni b\u00fcrokratik bariyerler konuluyor.<\/p>\n\n\n\n<p>Mahkeme karar\u0131yla hakk\u0131n\u0131 elde eden ki\u015fi dahi do\u011frudan icra yoluna ba\u015fvuramayacak; \u00f6nce devlete m\u00fcracaat edecek, devletin belirledi\u011fi s\u00fcreyi bekleyecek. Yani yurtta\u015f i\u00e7in mahkeme karar\u0131 bile hakk\u0131n\u0131 almaya yetmeyecek.<\/p>\n\n\n\n<p>Bu yakla\u015f\u0131m, devlet ile yurtta\u015f aras\u0131ndaki e\u015fitsiz ili\u015fkinin daha da derinle\u015ftirilmesinden ba\u015fka bir anlam ta\u015f\u0131m\u0131yor. Hukukun temel ilkelerinden biri olan taraflar\u0131n e\u015fitli\u011fi ilkesi bir kez daha devlet lehine a\u015f\u0131nd\u0131r\u0131l\u0131yor.<\/p>\n\n\n\n<p>&#8220;Yarg\u0131y\u0131 H\u0131zland\u0131rma&#8221; Ad\u0131 Alt\u0131nda Denetimin Tasfiyesi<\/p>\n\n\n\n<p>Tek hakimle g\u00f6r\u00fclecek dava kapsam\u0131n\u0131n geni\u015fletilmesi, istinaf mahkemelerine verilen yeni yetkiler ve temyiz s\u00fcre\u00e7lerinde yap\u0131lan de\u011fi\u015fiklikler, &#8220;etkinlik&#8221; ve &#8220;h\u0131z&#8221; s\u00f6ylemiyle sunuluyor.<\/p>\n\n\n\n<p>Oysa mesele yaln\u0131zca h\u0131z de\u011fildir.<\/p>\n\n\n\n<p>\u00d6\u011frencilerin disiplin cezalar\u0131ndan kamu emek\u00e7ilerinin \u00f6zl\u00fck haklar\u0131na kadar binlerce insan\u0131 ilgilendiren davalar\u0131n heyet incelemesinden \u00e7\u0131kar\u0131lmas\u0131, karar s\u00fcre\u00e7lerindeki kolektif denetimi azaltmak anlam\u0131na geliyor. Yarg\u0131 mekanizmas\u0131 daha h\u0131zl\u0131 hale gelirken ayn\u0131 zamanda daha merkezi ve daha az denetlenebilir bir yap\u0131ya b\u00fcr\u00fcnd\u00fcr\u00fcl\u00fcyor.<\/p>\n\n\n\n<p>T\u00fcrkiye&#8217;de sorun davalar\u0131n yava\u015f i\u015flemesi de\u011fil; siyasi iktidar\u0131n yarg\u0131 \u00fczerindeki etkisinin giderek kurumsalla\u015fmas\u0131d\u0131r.<\/p>\n\n\n\n<p>Dijital G\u00f6zetim Devleti G\u00fc\u00e7leniyor<\/p>\n\n\n\n<p>Paketin dikkat \u00e7eken ba\u015fl\u0131klar\u0131ndan biri de genetik verilerin ve dijital materyallerin saklanmas\u0131na ili\u015fkin d\u00fczenlemeler.<\/p>\n\n\n\n<p>Resmi gerek\u00e7e ki\u015fisel verilerin korunmas\u0131 olarak a\u00e7\u0131klansa da, fiiliyatta devletin bireyler \u00fczerindeki veri toplama ve g\u00f6zetleme kapasitesinin geni\u015fletildi\u011fi g\u00f6r\u00fcl\u00fcyor.<\/p>\n\n\n\n<p>Bug\u00fcn ileti\u015fim ara\u00e7lar\u0131ndan sosyal medya payla\u015f\u0131mlar\u0131na, telefon kay\u0131tlar\u0131ndan biyometrik verilere kadar geni\u015fleyen denetim mekanizmalar\u0131 d\u00fc\u015f\u00fcn\u00fcld\u00fc\u011f\u00fcnde, bu d\u00fczenlemeler yaln\u0131zca teknik de\u011fi\u015fiklikler olarak de\u011ferlendirilemez. Bunlar ayn\u0131 zamanda g\u00fcvenlik\u00e7i devlet anlay\u0131\u015f\u0131n\u0131n hukuki altyap\u0131s\u0131n\u0131n g\u00fc\u00e7lendirilmesi anlam\u0131na geliyor.<\/p>\n\n\n\n<p>Yarg\u0131n\u0131n As\u0131l Sorunlar\u0131 G\u00f6rmezden Geliniyor<\/p>\n\n\n\n<p>Paket boyunca yarg\u0131 ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131na ili\u015fkin tek bir ad\u0131m bulunmuyor.<\/p>\n\n\n\n<p>Gazetecilerin tutuklanmas\u0131, siyasi davalar, d\u00fc\u015f\u00fcnce su\u00e7lar\u0131, uzun tutukluluk uygulamalar\u0131, g\u00f6steri ve \u00f6rg\u00fctlenme hakk\u0131na y\u00f6nelik bask\u0131lar, kayy\u0131m politikalar\u0131, cezas\u0131zl\u0131k uygulamalar\u0131 ve kolluk \u015fiddeti kar\u015f\u0131s\u0131ndaki koruma mekanizmalar\u0131 yine dokunulmaz alanlar olarak b\u0131rak\u0131l\u0131yor.<\/p>\n\n\n\n<p>\u00c7\u00fcnk\u00fc sorun yarg\u0131n\u0131n i\u015f y\u00fck\u00fc de\u011fil; yarg\u0131n\u0131n siyasal iktidar\u0131n ihtiya\u00e7lar\u0131 do\u011frultusunda i\u015fleyen bir mekanizmaya d\u00f6n\u00fc\u015ft\u00fcr\u00fclm\u00fc\u015f olmas\u0131d\u0131r.<\/p>\n\n\n\n<p>Adalet De\u011fil, Y\u00f6netilebilirlik Aray\u0131\u015f\u0131<\/p>\n\n\n\n<p>Yarg\u0131 Paketi&#8217;nin b\u00fct\u00fcn\u00fc de\u011ferlendirildi\u011finde ortaya \u00e7\u0131kan tablo a\u00e7\u0131kt\u0131r: \u0130ktidar toplumsal adalet taleplerine yan\u0131t \u00fcretmeye de\u011fil, devlet ayg\u0131t\u0131n\u0131n i\u015fleyi\u015fini daha verimli hale getirmeye \u00e7al\u0131\u015fmaktad\u0131r.<\/p>\n\n\n\n<p>Emek\u00e7ilerin hak gasplar\u0131, siyasi tutsaklar\u0131n durumu, ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc ihlalleri, yarg\u0131 ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131 sorunu ve cezaevlerindeki insanl\u0131k d\u0131\u015f\u0131 ko\u015fullar \u00e7\u00f6z\u00fcm beklerken; devletin tahsilat\u0131n\u0131 kolayla\u015ft\u0131ran, denetim kapasitesini art\u0131ran ve yarg\u0131sal s\u00fcre\u00e7leri merkezile\u015ftiren d\u00fczenlemeler \u00f6n plana \u00e7\u0131kar\u0131lmaktad\u0131r.<\/p>\n\n\n\n<p>Ger\u00e7ek bir adalet reformu; saray\u0131n ihtiya\u00e7lar\u0131na g\u00f6re \u015fekillenen de\u011fil, halk\u0131n hak ve \u00f6zg\u00fcrl\u00fcklerini geni\u015fleten, siyasal bask\u0131 mekanizmalar\u0131n\u0131 tasfiye eden, yarg\u0131y\u0131 iktidar\u0131n de\u011fil toplumun hizmetine veren bir d\u00f6n\u00fc\u015f\u00fcmle m\u00fcmk\u00fcnd\u00fcr.
